Student Release and Informed Consent – Atira Tan Programmes

This Student Release and Informed Consent applies to all programmes, trainings, masterclasses and mentorships offered by Atira Tan.

I am participating in training, programmes, masterclasses and/or mentorships offered by Atira Tan (collectively, the “Programmes”) of my own will and volition, and voluntarily agree to all the terms and conditions of this Informed Consent and Release Agreement (“Agreement”). I am not under the influence of alcohol or drugs at this time and am sufficiently qualified, trained and capable to participate in the Programmes and all related activities (the “Programme activities”).

I understand and agree that I will be solely and exclusively liable for all my acts and omissions at all sessions, meetings and consultations related to any Programme, including but not limited to live training events, online sessions, my private practice and any unaffiliated locations where I may apply what I have learned.

I acknowledge and agree that the content of the Programmes is the exclusive intellectual property of Atira Tan (the “Intellectual Property”). I understand that Atira Tan is the exclusive owner or licensee of all materials used in the Programmes, including but not limited to printed, audio, video, digital, online and other materials (“Materials”). This includes all duplicates, reproductions, derivatives and related works such as research, books, articles, products and services created by Atira Tan and related to the Programmes.

Atira Tan retains all rights in and to all Intellectual Property used or referenced in the Programmes and the Materials, including copyrights and associated trademarks. No Materials, or any portion of them, are sold or otherwise transferred to me, and no title, ownership right or interest in the Materials is conveyed. I will not acquire any right of ownership, in whole or in part, in the Intellectual Property. Any goodwill that arises from my use of the Intellectual Property will inure solely to the benefit of, and become the property of, Atira Tan.

I agree that all personal information and material relating to any participant shared within a Programme is strictly confidential. I will not disclose any confidential information to any other person or entity under any circumstances. I will not make any audio, video, audiovisual or other recordings of any portion of a Programme, nor will I duplicate, reproduce, distribute, publish or discuss any confidential information contained in or related to the Programme. I agree not to record any sessions without prior written permission.

I understand that Atira Tan shall not be liable or responsible for any unauthorised recording of a Programme. I agree that Atira Tan has no liability or responsibility for the use or exploitation of any unauthorised recordings.

If, at any time, Atira Tan approves the recording of a Programme, I hereby grant to Atira Tan the right and permission to film, photograph, videotape and/or record me (including my image, picture, likeness and/or voice) and to use the resulting photographs, videos, digital imagery and/or recordings (collectively, the “Footage”), as edited or altered by Atira Tan, to create marketing and promotional materials, training materials, reports or other work product created by or for the benefit of Atira Tan (“Work Product”). I assign to Atira Tan all right, title and interest to the Footage and Work Product, including all copyrights, without any further compensation to me.

I release and discharge Atira Tan from any and all claims and demands that may arise out of or in connection with the use of the Footage, including, without limitation, claims for libel or violation of any right of publicity or privacy.

If I agree to participate in any Programme as the subject of a demonstration, I do so voluntarily and at my own risk. I understand that a demonstration session may include questions about my personal history, including trauma history, and emotional, psychological or physical symptoms I may be experiencing. I understand that I am under no obligation to participate, that I may refuse to answer any question and that I may pause or stop my participation at any time at my own discretion. I acknowledge that Atira Tan has no liability or responsibility for my participation in any demonstration.

I understand that the primary purpose of participating in the Programmes is educational – to observe and experientially learn how the principles and models taught by Atira Tan are applied in practice, in order to support my professional training and development.

I will at all times indemnify and hold harmless Atira Tan and any associated entities, together with their officers, directors, agents, successors and assigns (collectively, the “Released Parties”), from and against any and all claims, actions, damages, costs and expenses (including reasonable legal fees) related to my acts or omissions in providing services connected to any Programme.

I understand and agree that any sessions, meetings or consultations I may have with assistants, staff or third-party providers connected in any way to the Programmes (“Providers”) are undertaken at my own risk, and that Atira Tan does not monitor, control, influence or regulate these Providers. I release Atira Tan and the Released Parties from any and all liability or responsibility for any acts or omissions of any Provider and any claims related to them. I understand that no representations or warranties are made about the characteristics or quality of any services I may receive from such Providers.

If Atira Tan, or her authorised representatives, agents, coordinators or faculty members, request that I discontinue my participation in a Programme, I will immediately leave the session and/or premises (physical or virtual) where the Programme is being held. If I withdraw from a Programme, I understand that the applicable refund policy for that Programme will apply.

I understand that my participation in the Programme activities may present a health risk to me and, if I am pregnant or may be pregnant, to my unborn child. Illness, stress and other periods of significant personal difficulty may also affect my health. If I have, or suspect I may have, any such risks and choose to proceed with a Programme, I do so at my own risk and accept full liability for my participation. If I withdraw from the Programme due to any health risk or pregnancy, the applicable refund policy will apply.

I am voluntarily engaged in the Programme activities with knowledge of the risks and assume any and all known and unknown risks of injury that may result from the Programme activities.

I hereby release the Released Parties from all liability to me and to my representatives, guardians, successors, assigns, heirs, children and next of kin for all liability arising from or related to this Agreement or to the Programme activities. This release includes, without limitation, damage caused by the active or passive negligence of any of the Released Parties. I accept personal responsibility for any losses that may arise from my participation in the Programmes and Programme activities.

This Agreement is the only agreement between me and Atira Tan regarding my participation and supersedes any prior agreement, whether verbal or in writing, and may only be modified in writing by Atira Tan. This Agreement is binding upon me and my heirs, executors, administrators and legal representatives.

I acknowledge that I have carefully read this Agreement, understand its contents and understand that this Agreement includes an assumption of risk and a release of the Released Parties’ negligence and liability. I understand that Atira Tan is materially relying on this waiver in allowing me to engage in the Programme activities.

I agree to abide by all policies, procedures and guidelines posted on www.atiratan.com or otherwise communicated to me in relation to the Programmes. These policies, procedures and guidelines may change without notice and will be updated on the website. I understand and agree that it is my responsibility to check the website for updates and that I am bound by such policies, procedures and guidelines.

This Agreement shall remain in full force and effect throughout my participation in any current or future Programme with Atira Tan.
